ORDER OF INCORPORATION

Now on this 10th day of March, 1952, at 10:00 a.m. of said day the Board of County Commissioners of Marion County, State of Kansas, met in regular session at the office of said Board of Commissioners in the Courthouse, Marion, Kansas, George Merilatt, Chairman, George S. Jost, Commissioner and Carl Spangler, Commissioner, being present.

WHEREUPON, the petition for incorporation of the village of Goessel, Kansas, as a City of the Third Class, comes on for hearing before said Board of County Commissioners, and said Board of County Commissioners, finds:

1.    That the following described tract of land, to-wit:

       Beginning at the northwest corner of Section Eight, Township 21, South, Range One East of the 5th P.M., Marion County, Kansas; thence south one quarter mile; thence east one quarter mile; thence due north on the said quarter mile line to a point on the south line of Commercial Street in the village of Goessel, Kansas; thence due east on said south line of Commercial Street extended to the half section line of said Section Eight; thence due north on said half section line to the northeast corner of the south half of the Southeast Quarter of the Southwest Quarter of Section Five, township, 21 South, Range One East of the 5th P.M., Marion County, Kansas; thence west one half mile to the northwest corner of the south half of the Southwest Quarter of the Southwest Quarter of Section Five, Township, 21 South, Range One East of the 5th P.M., Marion County, Kansas; thence south one eighth mile to the point of beginning and containing 93.5 acres more or less

now comprises the unincorporated village and commons of Goessel, Kansas, and that such tract of land described is wholly within the County of Marion, Kansas.

2.    That a properly verified census return is filed with and made a part of the petition for Incorporation herein above referred to, which census return shows that the inhabitants of such unincorporated village of Goessel, aforesaid, number 253 persons, same being more than 100 and less than 2,000 persons, and which census return said Board of County Commissioners finds in all respects true and correct and in compliance with the laws of the State of Kansas.

3.    That a majority of the taxable inhabitants of such village of Goessel, Kansas, are in favor of the incorporation of such village as a city of the third class, under the laws of the State of Kansas.

4.    That the prayer of the petition aforesaid is in all respects reasonable and proper.

5.    That proper notice of the time and place of this hearing has been given according to law to all inhabitants of the territory and tract of land above described and forming a part of the unincorporated village and commons of Goessel, Kansas, which tract of land is the subject of this order of incorporation, as evidenced by the “Certificate of Posting Petition, executed by R. D. Voth on the 18th day of February, 1952,” which is filed with the Board of Commissioners.

NOW THEREFORE, it being found by the Board of County Commissioners of Marion County, State of Kansas, that all legal steps precedent to the incorporation of the Village of Goessel, Kansas, and as above described in metes and bounds description, having been taken, and all acts, conditions and things required to be done precedent to incorporation having been properly done have happened and been performed in regular and due form, it is found that said Petition for Incorporation should be allowed and it is therefore

ORDERED AND DECLARED

that the following described tract of land, to-wit:

       Beginning at the northwest corner of Section Eight, Township 21 South, Range One East of the 5th, P.M., Marion County, Kansas; thence south one quarter mile; thence east one quarter mile; thence due north on the said quarter mile line to a point on the south line of Commercial Street in the village of Goessel, Kansas; thence due east on said south line of Commercial Street extended to the half section line of said Section Eight; thence due north on said half section line to the northeast corner of the south half of the Southeast Quarter of the Southwest Quarter of Section five, Township 21 South, Range One East of the 5th P.M., Marion County, Kansas; thence west one half mile to the northwest corner of the south half of the Southwest Quarter of the Southwest Quarter of Section Five, township 21 South, Range One East of the 5th P.M., Marion county, Kansas; thence south one-eighth mile to the point of beginning and containing 93.5 acres more or less,

shall from this date be incorporated as a city of the third class under the laws of the State of Kansas, by the name and style of

“THE CITY OF GOESSEL, KANSAS”

as provided by Chapter 187 of the Session Laws of the State of Kansas for the year 1951, and henceforth the inhabitants within such above described metes and bounds territory and such further territory as from time to time may be lawfully added thereto shall be a body politic and corporate by that name and they and their successors (except such corporation be lawfully dissolved) shall have perpetual succession.

It is further ordered that an election shall be held at B. J. Klassen garage in the City of Goessel, Kansas, on the 1st day of April, 1952, commencing at 8:00 a.m. and closing at 5:00 p.m. for the purpose of electing a mayor and five councilmen to the governing body of the City of Goessel, Kansas.

It is further ordered that Mrs. Waldo Voth, Mrs. J. Willard Linscheid and Mrs. A. K. Ratzlaff, each a duly qualified elector of said City of Goessel, Kansas, shall act as judges of such election and it is ordered that Mrs. Adolf Schmidt and Mrs. W. O. Schmidt shall act as clerks of such election.

lt is further ordered that Orlan F. Frey, J. G. Klassen and Waldo O. Voth, each a duly elector of said City of Goessel, Kansas, shall act as a board of canvassers of such election returns.

It is further ordered that J. G. Klassen, a duly qualified elector of said City of Goessel, Kansas, shall at as City Clerk for the City of Goessel, Kansas until the governing body of such city shall appoint a successor in such office who shall duly qualify as such City Clerk.

It is further ordered that all proceedings in such election shall be had in accordance with the general election laws of the State of Kansas, insofar as same are applicable.

It is further ordered that this Order of Incorporation shall be; forthwith entered upon the journal of the Board of County Commissioners of Marion County, Kansas, and shall be published within the City of Goessel, Kansas, as provided in Chapter 187 of the Session Laws of the State of Kansas for the year 1951, proof of which shall be filed herewith within seven days from this date and shall be entered upon the journal of this board when so filed.
